Welcome to humanopinion, the online repository of human opinion, thought and spirit. An unbiased non-partisan website, created for all people. A platform where all of humanity can request opinions from others, form and voice their opinion and view those of others. A place where all of this is recorded for the benefit of society today, and hopefully, generations to come.
The Services offered by humanopinion Ltd ("humanopinion" or "we") include: the humanopinion.org website (the "Website"), and any other features, content, or applications offered from time to time by humanopinion in connection with the humanopinion Website (collectively, the "humanopinion Services").
This Agreement includes humanopinion's policy for acceptable use of the humanopinion Services and Content posted on the humanopinion Website, your rights, obligations and restrictions regarding your use of the humanopinion Services and humanopinion's Privacy Policy. In order to participate in certain humanopinion Services, you may be notified that you are required to download software or content and/or agree to additional terms and conditions. Unless otherwise provided by the additional terms and conditions applicable to the humanopinion Services in which you choose to participate, those additional terms are hereby incorporated into this Agreement.
ACCEPTANCE OF TERMS

ELIGIBILITY
Membership in the humanopinion Services is void where prohibited.

Services shall include, but not be limited to, any service and content humanopinion performs for you, as well as the offering of any materials displayed or performed on the Website (including, but not limited to text, everything associated with RFO's (requests for opinions), user comments, messages, information, data, graphics, news articles, photographs, images, illustrations, software, audio clips and video clips, also known as the "Content") on the Website. humanopinion may change, suspend or discontinue the Services including any Content for any reason, at any time, including the availability of any feature or content. humanopinion may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.
YOUR REGISTRATION OBLIGATIONS
As a condition to using the humanopinon Services, you are required to register with humanopinion and select a password and screen name ("humanopinion Username"). You shall provide humanopinion with accurate, complete, and updated registration information and insure your use of the humanopinion Services does not violate any applicable law or regulation. Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your humanopinion account. You may not (i) select or use as a humanopinion Username a name of another person with the intent to impersonate that person; (ii) use as a humanopinion Username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as a humanopinion Username a name that is otherwise offensive, vulgar or obscene. humanopinion reserves the right to refuse registration of, or cancel a humanopinion Username in its discretion. You shall be responsible for maintaining the confidentiality of your humanopinion password.
You agree to notify humanopinion immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
USER CONDUCT
As a condition of use, you agree not to use the Services for any purpose that is unlawful or prohibited by these Terms of Use, or any other purpose not reasonably intended by humanopinion.
By way of example, and not as a limitation, you agree not to use the humanopinion Services:
A. to abuse, harass, threaten, impersonate or intimidate humanopinion, other humanopinion users, or any other 3rd party;
B. to contribute any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive or otherwise violates any law or right of any third party;
C. for any illegal or unauthorized purpose. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
D. to post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from humanopinion, the Website, or any humanopinion user;
E. to create or submit unwanted email ("Spam") to humanopinion, any other humanopinion users or 3rd party, or any URL;
F. to violate any laws in your jurisdiction (including but not limited to copyright laws);
G. to submit stories or comments linking to affiliate programs, multi-level marketing schemes, sites/blogs repurposing existing stories (source hops), or off-topic content;
H. With the exception of accessing RSS feeds, you will not use any robot, spider, scraper or other automated means to access the website for any purpose without our express written permission. Additionally, you agree that you will not: (i) take any action that imposes, or may impose in our sole discretion an unreasonable or disproportionately large load on our infrastructure; (ii) interfere or attempt to interfere with the proper working of the website or any activities conducted on the website; or (iii) bypass any measures we may use to prevent or restrict access to the website and if for any reason you do so, you must notify us immediately and inform us, in full detail of the security vulnerability;
I. to create separate user accounts with the intention of artificially inflating the 'RFO counts', discussions, comments, or any other humanopinion service.
humanopinion may remove any content and humanopinion accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all. Please choose carefully the information you post on the Website and which you provide to other users. Your humanopinion public profile should not include the following items: telephone numbers, street addresses, last names, and any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter. Despite this prohibition, information provided by other humanopinion members (for instance, in their public profile) may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and though we do our reasonbly best to ensure this doe not happen, humanopinion assumes no responsibility or liability for this material. LIMITATION OF LIABILITY

TERMINATION
humanopinion may terminate or suspend any and all humanopinion Services and your humanopinion account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use, or for any reason what-so-ever under humanopinions sole discretion. Upon termination of your account, your right to use the humanopinion Services will immediately cease. If you wish to terminate your humanopinion account, you may delete your humanopinion account (through your 'my opinion' page) and simply discontinue using the humanopinion Services. All provisions of the Terms of Use which by their nature should survive termination, shall survive termination, including, without limitation to, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
INDEMNITY

GOVERNING LAW AND VENUE

By visiting or using the Website and/or the humanopinion Services, you agree that the laws of Ireland, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and humanopinion or any of its affiliates.
Any dispute relating in any way to the Website and/or the humanopinion Services (including your visit to or use of the Website and/or the humanopinion Services) shall be submitted to confidential arbitration in Ireland, except that, to the extent you have in any manner violated or threaten to violate humanopinion or any of its affiliates' proprietary or intellectual property rights, we may seek injunctive or other appropriate relief in any country, state, or federal court of competent jurisdiction. For the purpose of such relief, you hereby consent to, and waive all defences of lack of personal jurisdiction and forum non conveniens with respect to, non-exclusive venue and jurisdiction in the courts of Ireland.
Arbitration under this Agreement shall be conducted under the rules then prevailing of the court of Ireland. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms of Use shall be joined to an arbitration involving any other party subject to these Terms of Use, whether through class arbitration proceedings or otherwise. Any claim, action or proceeding by you related in any way to the Website and/or the humanopinion Services (including your visit to or use of the Website and/or the humanopinion Services) must be instituted within one (1) year after the cause of action arose or be forever waived and barred.
These terms shall be governed by and interpreted in accordance with the laws of Ireland.
In any action or proceeding to enforce rights under the Terms of Use, the prevailing party will be entitled to recover costs and attorneys' fees.
OTHER
No agency, partnership, joint venture, or employment is created as a result of the Terms of Use and you do not have any authority of any kind to bind humanopinion in any respect whatsoever.
The Terms of Use are not assignable, transferable or sub licensable by you except with humanopinion's prior written consent. humanopinion may transfer, assign or delegate the Terms of Use and its rights and obligations without consent.
Both parties agree that the Terms of Use, together with the Privacy Policy and any other policies of humanopinion posted by us on the Website, constitute a complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of these policies, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein. The failure of humanopinion to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision in that or any other instance. If there is any conflict between these terms and specific terms appearing elsewhere on humanopinion then the latter shall prevail.
The section titles in this Agreement are for convenience only and have no legal or contractual effect.
If any provision of this Agreement is determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which this Agreement is intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be limited or eliminated, to the minimum extent necessary, so as to be enforceable to the maximum extent permissible by law, and the remaining Terms of Use shall survive, remain in full force and effect and continue to be binding and enforceable.
